These Terms & Conditions (“Terms”) govern your use of the website and mobile applications published by KScape Pte. Ltd. (“KScape”, “we”, “us”, or “our”), a company registered in Singapore (UEN 202613431E) with its registered office at 40 Toh Guan Road East #01-65, Enterprise Hub, Singapore 608582 (together, the “Services”). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Licence to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use our applications for your personal or internal business purposes. We reserve all rights not expressly granted.
Acceptable use
You agree not to:
- copy, modify, reverse-engineer, or create derivative works of the Services, except as permitted by law;
- use the Services for any unlawful, harmful, or fraudulent purpose;
- interfere with or attempt to gain unauthorised access to the Services or related systems;
- resell, sublicense, or commercially exploit the Services without our written consent.
Subscriptions and payments
Some apps offer paid features or subscriptions. Purchases and subscriptions made through an app marketplace (for example, the Apple App Store) are subject to that marketplace’s terms. Subscriptions may renew automatically unless cancelled, and you can manage or cancel them through your marketplace account settings. Except where required by law or marketplace policy, payments are non-refundable.
Intellectual property
The Services, including all software, text, graphics, logos, and trademarks, are owned by or licensed to KScape and are protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
Third-party services
The Services may rely on or link to third-party services (such as app marketplaces and sign-in providers). We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.
Disclaimer of warranties
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, KScape will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from or related to your use of the Services. Nothing in these Terms limits liability that cannot be excluded under applicable law.
Termination
We may suspend or terminate your access to the Services at any time if you breach these Terms or where necessary to protect the Services or other users. You may stop using the Services at any time.
Governing law
These Terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute arising from them, without regard to conflict-of-law principles.
Apple App Store
For apps downloaded from the Apple App Store, these Terms are between you and KScape only, not with Apple, and Apple is not responsible for the apps or their content. These Terms supplement, and do not replace, Apple’s standard licensed application end-user licence agreement.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
